A man who stripped naked and tried to rape a woman in her home in Birmingham during a drug and alcohol fuelled knife attack has been jailed for 12 years. The victim, who suffered a of injuries including a punctured lung, was also strangled by Sorin Mischia. Mischia, 30, of Church Lane, Erdington , a Romanian national, was cleared of attempted murder but convicted of wounding with intent following a trial at Birmingham Crown Court.

Matthew Brook, prosecuting, told the court the defendant had gone out drinking with the victim's brother on October 17 last year. They went to a restaurant then a city centre bar before going to the brother's home in Erdington where he lived with his sister, the court heard. In the early hours of the following day, Mischia, who later told police he had taken cocaine, had gone into the woman's bedroom and asked if she could help him set up a sofa bed in the lounge. He said the victim went back to bed but was awoken again by the defendant, who told her there was somebody outside and the light was on.

Mr Brook said: "It was at this point she saw the defendant. He was stripped naked and had a kitchen knife with a black handle behind his back. He said during the attack Mischia put a knife to the woman's throat and started to choke her. She tried to go upstairs where her brother was asleep but the defendant caught up with her, stamped on her head and used a second knife to stab her in the back. Police who were called to the scene found Mischia naked and covered in blood lying the road.

The defendant had tried to claim he had been the victim and that the woman had attacked him but a jury rejected his story. Judge Richard Bond increased the period Mischia would remain on licence following his release from prison by three years, saying he represented a danger to women. He said the defendant had bought some cocaine on the journey to the flat which he had then taken there.

The judge said "You made this decision in the lounge and removed all of your clothes and armed yourself with a kitchen knife. I am sure, having heard the evidence, you intended to rape her. You went into her bedroom naked and armed with a knife. There is no other reason. All she had done was help you. The injuries were grave.
